“OakGov Challenge”
SPONSORED BY AT&T AND OAKLAND COUNTY
1. NO PURCHASE NECESSARY TO ENTER OR WIN A PRIZE. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID OUTSIDE OF THE FOLLOWING COUNTIES IN MICHIGAN: GENESEE, LAPEER, LIVINGSTON, OAKLAND AND ST.CLAIR, AND WHERE PROHIBITED OR RESTRICTED BY LAW. OTHER MICHIGAN COUNTIES MAY EVENTUALLY BE INCLUDED IF THEY JOIN THE MICHIGAN ECONOMIC GROWTH ALLIANCE DURING CONTEST PERIOD.
2. Contest Overview: Oakland County (“OC”), in conjunction with AT&T are joint “Sponsors” of the OakGov Challenge to encourage residents, students and business people of the Michigan Economic Growth Alliance region (“EGA”) to develop, specifically for this Contest, cutting edge, innovative, creative and user friendly mobile and web based applications focused on enhancing the communication and interaction between the citizens, businesses and government of the EGA. There will be one first, one second and one third place prize awarded in Contest. The first and second place prize will be based on all of the evaluation criteria specified in these Official Rules while the third place prize will be based solely on the application concept. Entrants that enter by only submitting an application idea will only be eligible for the third place prize.
3. Registration and Entry Period: “OakGov Challenge” (“Contest”) registration period commences at 9:00:00 AM ET on February 15, 2010 , and ends at 12:00:00 PM (Noon) ET on June 11, 2010, (“Registration Period”). Contest entry period commences at 9:00:00 AM ET on March 1, 2010, and ends at 12:00:00 PM (Noon) ET on June 11, 2010, (“Entry Period”, and together with Registration Period, “Contest Period”). All entries must be received by 12:00:00 PM (Noon) ET on June 11, 2010. All interpretations of these Official Rules and decisions relating to the Contest made by Sponsors are final.
4. Eligibility: The Contest is open to legal US residents that are living or working in, or are enrolled in an educational facility, in any of the counties in Michigan that are or become during the Contest Period, part of the Economic Growth Alliance (“EGA”), presently, Genesee, Lapeer, Livingston, Oakland and St. Clair counties, but will include any additional counties that may join EGA during Contest Period. Entrants must be at least 18 years of age or older at time of entry to enter Contest. Entrants can participate individually (“Single Entrant(s)”), or as a member of a team of up to four (4) individuals (“Team Entrant(s”), and together with Single Entrant, “Entrants”). Team Entrants are permitted to participate in Contest provided that each team member meets the eligibility requirements of the Official Rules and that one (1) team member is designated by the team to be the Primary Contact (“Primary Contact”). The Primary Contact will enter the Contest and agree to all of the terms and conditions of the Official Rules on behalf of the team and agrees to be available for communications on behalf of the team with Sponsors and Administrator (hereinafter defined). Entrants must not be at time of entry, during Contest Period or at time of Prize (hereinafter defined) fulfillment and acceptance, a party to any agreement that might present a conflict or interfere with Entrant’s participation in the Contest and/or acceptance of the Prize. Sponsors reserve the right, in their sole discretion, to disqualify any Entrant who is under any agreement which Sponsors deem to be in conflict with the nature of Contest. Employees and their immediate families (i.e., parents, spouse, siblings, children, grandparents, step parents, step children, and step siblings, and their respective spouses, and those living in the same household, whether or not related) of Sponsors, and The Marketing Arm, Inc., (“Administrator”), and their respective parent companies, affiliated companies, subsidiaries, sponsors, partners, dealers, manufacturers, distributors, subcontractors, advertising agencies, promotion and administration agencies and any entity which is involved in any aspect of the creation, production, operation, execution and fulfillment of Contest, and their respective agents, employees, officers, directors, successors and assigns, together with the Sponsors, Administrator, and EGA, (“Contest Entities”), are not eligible to enter Contest. By participating in this Contest, Entrants: (a) agree to be bound by these Official Rules and by the interpretations of these Official Rules by Sponsors and by the decisions of Sponsors; (b) acknowledge compliance with these Official Rules; (c) agree to comply with any and all applicable federal, state and local laws, rules and regulations; and d) agree to release and hold harmless Contest Entities from and against any and all claims, injury or damages arising out of or relating to participation in Contest and/or the use, misuse or redemption of the Prizes, and for any claim, including claims based on defamation, publicity rights, invasion of privacy, copyright infringement, trademark infringement, or any other intellectual property related cause of action.
5. To Enter: Entrants can submit applications that are either mobile or web based.
Mobile Applications
The application must be able to operate on the AT& T Mobile Network and must utilize Smartphone technology such as, but not limited to the following platforms: iPhone, Blackberry, Window Mobile, or Android. There are no defined requirements for the mobile application database.
Web Applications
The application must: (a) be written in one of the following programming languages for the .Net platform (C# or VB.Net), (b) be a thin-client web application (thick client applications will not be considered), (c) at a minimum be functional in Internet Explorer 7 or higher; and (d) utilize either MS Sql Server 2000 or higher or MySql, if a database is utilized.
Provided Data OC will provide sample, mock data (“Provided Data”) for use in Submissions. This Provided Data will contain scrambled data to avoid providing personal information. Contest Entities expressly disclaim that Provided Data is free of any errors, defects or omissions and it should not be relied upon for accuracy.

To register visit http://oakgovchallenge.com (“Website”), a website owned and controlled by Oakland County and follow the instructions.
For Single Entrants: During Registration Period visit Website and complete all required fields on the registration form and submit as requested. Only fully completed submission forms are eligible.
For Team Entrants: During Registration Period the member of the Team Entrant designed as Primary Contact must visit Website and complete all required fields on the registration form and submit as requested. Only fully completed submission forms are eligible. Primary Contact must include the names of all of the Team Entrants when entering Contest

After Entrant has completed the Contest registration process specified above, Entrant can then proceed to submit their Contest entry by completing and submitting via the website the following:
Official Contest submission form found at Website
A one page application overview, indicating the purpose, functionality and intended audience of the application. This overview should be in PDF, Word format.
One (1) to ten (10) screen shot(s) of the application. These screen shots should be in PDF, Word or PowerPoint format.
A zip file containing all application source code, and any other files required by the application to function.
Note: If Entrant elects to submit only an idea for an application, and not a complete application, then the Entrant will only need to complete and submit an
Idea form indicating: Concept, impact on citizens or government, target market and any financial or efficiency savings. In addition, Entrants may provide any supporting documents in PDF or Word format.
Entrants must also be prepared to submit additional materials at the request of Sponsors if they are selected as a Finalist (hereinafter defined) or Winner, including but not limited to, additional formats of Submission (hereinafter defined).
Entrants, including up to four (4) members of Team Entrant, must also be prepared to present their Submission to a panel of judges at a 30 minute presentation, if they are selected as a Finalist. This presentation may include a question and answer period wherein Entrants must answer questions from judges relating to their Submission, “Presentation”). The Presentation will take place at an Oakland County facility on August 18th and 19th 2010, and in order to participate in Presentation and have the chance to be selected as a Winner, Finalist, including up to four (4) members of Team Entrant, must be available on the date specified by Sponsors. The date for Presentation is subject to change in Sponsors sole discretion.
There is no limit to how many Submissions an Entrant can submit to Contest, however there is a limit of only one (1) prize to each Entrant. In the event an Entrant is determined to be a Winner as a Single Entrant and also as a Team Entrant, Entrant will be awarded a total of one (1) Prize which will be the highest dollar value Prize of the two Prizes they are eligible for. In the event of a dispute over who submitted a winning online entry, the authorized subscriber of the e-mail account, used to participate in Contest at the actual time of entry, will be deemed to be the Entrant. The authorized account subscriber for online submissions is defined as the natural person who is assigned an e-mail address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted e-mail address. Proof to Sponsor’s satisfaction of being the authorized account subscriber may be requested by Sponsors.
6. Submission Guidelines: All contents of Entrants submissions, including but not limited to, content, text, images, graphics, photographs, captions and descriptions, data, codes and programs, hereinafter referred to as (“Submission” or “Submissions”), must be completely original to Entrants and must not have been taken or composed, in whole or in part, from any other source other than Entrant, must have been created specifically for this Contest and must not have been released commercially in order to be eligible for submission to Contest.
Submissions which contain materials that are not the original work of the Entrant, or are illegible or incomplete, will not be accepted. If a Submission was created via a collaborative effort, each person that made a contribution to such Submission, or has any right, title or interest in such Submission, must be listed as a Team Entrant.
Submissions must not include, depict or involve any of the following: obscenity, inappropriate language, nudity, explicit sexual activity, illegal drug or alcohol use, violence, commercial products, unauthorized copyrighted or trademarked properties, including brand names and logos, private property, unless Entrant has obtained a property release specific for uses specified herein, material that is hateful, tortuous, defamatory, slanderous, libelous, or otherwise unlawful, material that violates or infringes another’s rights, including but not limited to, rights of privacy or publicity or any other intellectual property rights, material that promotes bigotry, racism, hatred or harm against any group or individual, or promotes discrimination based on race, ethnicity, sex, religion, nationality, disability, sexual orientation or age, including but not limited to and any other content, including but not limited to, text, images, graphics, photographs, captions and descriptions, data, codes and programs that could be considered inappropriate or offensive, as determined by Sponsors in their sole discretion.
Sponsors reserve the right, in their sole discretion, to disqualify any Submission that it deems to be a violation of any of Contest Official Rules or that are not in keeping with Sponsors image. Sponsors may modify or edit any Submission, or request Entrant to do so, so that such Submission meets such standards. Sponsors are not obligated to use, publish or display or broadcast any Submission.
By entering Contest, each Entrant represents and warrants that: (a) it has all rights to the contents of Submission and all components thereof, and that Entrant has obtained all rights, consents, and permissions, including, but not limited to, those of any persons that may have participated in Submission, necessary to grant the rights granted herein; (b) that the Submission was created specifically for Contest, (c) that the Submission, in whole or in part, has not been released commercially; (d) the Submission does not and will not violate any law, statute, ordinance or regulation; (e) the Submission is free and clear of any and all liens or claims with respect to the use of the Submission in the manner authorized herein, and will not give rise to any claims of infringement, invasion of privacy or publicity, or infringe on any rights or interests of any third party, or give rise to any claims for any payment whatsoever; and (f) the Submission is not and will not be defamatory, libelous, pornographic or obscene.
All Entrants, whether a Winner or not, agree that in consideration for being permitted to enter this Contest, they are granting AT&T, OC and EGA, and their respective representatives, in whole or in part, (a) the right to edit, adapt, reformat, rearrange, modify, combine with other material, add to and customize Submission, and to reverse engineer source code provided in Submission; and (b) the non exclusive, irrevocable right and license to exhibit, display, broadcast, copy, reproduce, encode, compress, encrypt, incorporate data into, rebroadcast, transmit, record, publicly perform, create derivatives works of, distribute and synchronize in timed relation to visual elements, and or otherwise exploit, the Submissions, and/or any portions or excerpts thereof, in any manner, including advertising, promoting and publicizing AT&T and OC, an unlimited number of times, in any and all media, now known or hereafter devised, in perpetuity, throughout the world, without any additional payment, liability or obligation of any kind to Entrant or any third party.
Entrants also acknowledge and agree that AT&T, OC and EGA shall own all right, title and interest, including all copyright ownership, in any derivative works they may create from any element of Submission.
Entrants also agree to obtain, upon request from Sponsors, any documentation necessary to prove their unrestricted ownership in all contents of Submission and their right to use Submission as specified in the Official Rules.
Entrants retain all right, title and interest which the Entrant may have in and to their Submission, including copyright and any other intellectual property rights.
Sponsors assume no responsibility for, and will not resolve, any disputes among Team Entrants with regard to the Contest, the Submission and/or any other matter. In the event that any such disputes interfere with the operation of the Contest, Team Entrants, including all members of Team Entrant, may be disqualified from Contest in Sponsors absolute and sole discretion.
All entries submitted in compliance with these Official Rules and not disqualified are considered “Eligible Submissions”. Submissions will not be returned and receipt of Submissions will not be acknowledged.
7. Prizes: There will be three (3) Winners. A Team Entrant that is a Winner is considered one (1) Winner with the Team Entrant receiving a total of one (1) Prize and that Prize being distributed evenly between the team members. The Prizes are as follows: the first place Winner will receive $6,500 cash, the second place Winner will receive $3,000 cash, and the third place Winner will receive $500 cash, collectively (“Prize” or “Prizes”). The total approximate retail value (“ARV”) of all of the Prizes is $10,000.
8. Judging: Judges will include but will not be limited to representatives of Oakland County, AT&T and news and media (“Judges”). There will be approximately 10 finalists selected from the Eligible Submissions, (“Finalist” or “Finalists”). The Judges will evaluate the Submissions on the following four criteria, which will be weighted equally: (a) concept, (b) design, implementation and quality, (c) impact on the community and government; and (d) business case presented. The Judges reserve the right to conduct interviews with any Entrant. The Judges also reserve the right to declare or not to declare any Finalists or Winners if, in their sole discretion, the Submissions do not meet the qualification standards based on the judging criteria specified herein. The application of the judging criteria shall be in the sole and absolute discretion of the Judges. In the event of a tie or dispute or for any other reason that Sponsor deem necessary, determination of the Finalists and Winners will be made by Sponsors. Contest Entities and Judges disclaim any liability from any Entrant and Entrants agree to waive any claims against Contest Entities and Judges relating to the judging or awarding process. Idea submissions may require an onsite presentation for judging.
9. Finalist Selection and Notification: Finalists will be selected among all of the Eligible Submissions on or about Thursday, July 8, 2010. Administrator will make up to three (3) attempts over the 72 hour period following each Finalist selection to contact the potential Finalists, or the Primary Contact of a Team Entrant that is a potential Finalist, via the telephone number(s) provided on his or her submission form. If a potential Finalist, or Primary Contact of a Team Entrant, cannot be reached directly during the 72 hour period in which he or she is called, the potential Finalist will be disqualified and an alternate Finalist may be selected, in Sponsor’s sole discretion, from among the remaining applicable Eligible Submissions received if time permits. In addition, Sponsors reserve the right to select an alternative Finalist in the event that any potential Finalist, including any member of a Team Entrant, fails to comply with these Official Rules. Finalists will then be required to participate in Presentation in order to be considered for Winner designation. If Finalist is not available to attend Presentation on the date specified by Sponsors, Finalist privileges will be terminated and an alternative Finalist may be selected who according to the opinion of the Judges was the next in contention for Finalist designation from the remaining Eligible Submissions.
10. Winner Verification: The potential winners, including each member of team if a Team Entrant, must prove eligibility, including, without limitation, proof of age, residence and identity, which may include submitting a copy of a driver’s license, passport or similar government issued identification, as well as proof that he or she, or Primary Contact as applicable, is the authorized account subscriber of the email address of the winning Submission, within three (3) days of being notified as a potential winner. In the event of non-compliance by the potential winner, including any member if a Team Entrant, such potential winner, and all team members of Team Entrant, shall be disqualified and all privileges otherwise due as the Winner shall be terminated and an alternative potential winner may, in Sponsor’s sole discretion, be chosen from among all of the remaining Eligible Submissions received. To be eligible to be declared a Winner and to receive the Prizes, the potential winner, including each member of a Team Entrant, must sign, within five (5) days of receipt of such documents from Administrator or Sponsor: (a) Affidavit of Eligibility and Release releasing Contest Entities from any and all liability, loss, claims, demands, and causes of action for personal injuries or death and/or damage to personal or real property, theft, loss or any other harm suffered directly or indirectly from potential winner’s participation in Contest, including, but not limited to, traveling to, preparing for and/or participating in any Prize related activity, or the acceptance, possession, or misuse of any Prize, to be eligible for the Prize; and (b) except where prohibited by law, a publicity release granting Contest Entities the right to use potential winner’s name, picture and/or likeness, or biographical information or voice for trade, advertising and publicity purposes, in any media now or hereafter known, throughout the world in perpetuity without additional compensation or consideration or notification; and (c) a non-exclusive, irrevocable, royalty free, license, in perpetuity granting AT&T and EGA the right to use the Submission as specified herein; and (d) any other documentation as may be required to document AT&T and EGA ownership of all right, title and interest, including al copyright ownership, in any derivative works they may create from any element of Submission. Entry into Contest constitutes agreement to sign such releases and documents, and when properly executed by each potential winner, including each member of Team Entrant, and providing potential winner, and each member of Team Entrant, is in compliance with the Official Rules, potential winners will be determined to be (“Winner” or “Winners”). Sponsors expressly reserve the right to delay the announcement of the Winners for any reason Sponsors deem necessary.
11. Prize Terms: The dates for fulfillment of the Prizes will be on or around August 20, 2010 but subject to change in Sponsor’s sole discretion. If for any reason any Prize is unavailable or any Prize related event is delayed, cancelled or postponed, Sponsors reserve the right, but are not obligated, to cancel or modify the Contest in its sole discretion and award a substitute Prize, or portion of Prize, of comparable or greater value. No substitutions, transfer, assignment or cash equivalent of the Prize, or any portion thereof, by Entrant is permitted. Contest Entities shall have no responsibility or obligation to a Winner or potential winner who is unable or unavailable to accept or utilize the Prizes as described herein. All costs and expenses not specifically listed above as part of the Prize are solely Winner’s responsibility. Arrangements for the fulfillment of the Prizes will be made by Administrator.
Winners, including each member of a Team Entrant that is a Winner, must complete a W9 form and supply Administrator and/or Sponsors with his or her social security number or Employer Identification Number for tax purposes. The value of the Prize will be taxable to Winners, including each member of a Team Entrant for its share that it received, as income. An IRS Form 1099 will be issued in the name of Winner, including each member of a Team Entrant for its share that it received, for the actual value of the Prize received if the actual value of Prize is over $600. All federal, state and local taxes, and any other costs and expenses associated with acceptance and use of Prize not specifically provided for in these Official Rules are solely the Winner’s responsibility.
12. General Terms: Contest Entities are not responsible if Contest cannot take place, or if any Prize cannot be awarded due to delays, interruptions or failures due to acts of God, war, natural disasters, weather, acts or threats of terrorism, strikes, lockouts, labor disputes, work stoppages, fire, acts of government, or other events outside of the reasonable control of Contest Entities. If, for any reason Contest is not capable of running as planned, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Contest Entities, which, in Sponsor’s sole determination, corrupts or affects the administration, security, fairness, integrity or proper conduct of this Contest, Sponsors reserve the right, in their sole discretion, to cancel, terminate, modify, or suspend Contest or any part of the Contest. Sponsors reserve the right to modify and amend these Official Rules from time to time during Contest for clarification purposes without materially affecting the terms and conditions of the Contest. If Contest is terminated prior to the expiration date stated herein, notice will be posted on http://oakgovchallenge.com and the Prizes may be awarded to new winners to be selected from among all Eligible Submissions received up until and or after, if applicable, the time of modification, cancellation or termination or in a manner that is fair and equitable as determined by Sponsors.
Entrants agree to indemnify and hold harmless Contest Entities from any and all liability arising out of or relating in any way to Entrants participation in Contest and to release all rights to bring any claim, action or proceeding against Contest Entities. Contest Entities assume no responsibility for and will disqualify submissions that are: stolen, late, lost, illegible, incomplete, invalid, unintelligible, damaged, destroyed, delayed, misdirected (email and mail), that have incorrect or inaccurate submission information, whether caused by any of the equipment or programming associated with or utilized in Contest, or by any human, mechanical or electronic error which may occur in the processing of the submissions in Contest. Contest Entities assume no responsibility for any typographical or other error in the printing of the offer, administration of Contest, errors in processing entries, identifying the Winners, in the announcement of the Prizes and Winners, and the delivery of the Prizes, any problems or technical malfunction of any telephone network or lines, computer systems, online systems, servers or providers, computer equipment, software, failure of any e-mail or players on account of technical problems or traffic congestion on the Internet or on any web site, or any combination thereof, including, without limitation, any injury or damage to Entrants or any other person’s computer system/software related to or resulting from participation or downloading any materials in Contest. Use of any device to automate or subvert submission is prohibited. No software-generated, robotic, programmed, script, macro or other automated online entries are permitted and any submissions received by such means will be void. Sponsors reserve the right in their sole discretion to disqualify any person they suspect or find: (i) to have used a software generated, robotic, programmed, script, macro or other automated online entry; (ii) to have tampered with the submission process or the operation of Contest; (iii) to be acting in a disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person; (iv) to display behavior that will bring such Winner or Contest Entities into disgrace; (v) to have provided inaccurate information on any legal documents submitted in connection with Contest; or (vi) to be acting in violation of these Official Rules.
ANY VIOLATION OF THESE OFICIAL RULES BY A WINNER WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS A WINNER OF THE CONTEST AND ALL PRIVILEGES AS A WINNER WILL BE IMMEDIATELY TERMINATED.
ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAW AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITED BY LAW. THE MICHIGAN COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY CONTROVERSIES REGARDING THE CONTEST AND THE LAWS OF THE STATE OF MICHIGAN SHALL GOVERN THE CONTEST. EACH ENTRANT WAIVES ANY AND ALL OBJECTSIONS TO JURISDICTION AND VENUE IN THESE COURTS AND HEREBY SUBMITS TO THE JURISDICTION OF THESE COURTS.
